Post subject: Work Permit cancelled but Resident Permit still in Passport

I just finished my 3 years in Shanghai and returned my Work Permit Booklet to my employer and he canceled it. As I got transferred rather fast I never gave my Passport to the HR Office.

He mentioned now to me in a email that they will cancel my Resident Permit that is valid until 2010 online. So I am wondering now if they can do so indeed and if yes, how can I find out whether it is canceled or not ?

I am just curious as to whether I can still use the Permit in my Passport to enter China with this Permit until it expires in August 2010.

Unless it was an ugly termination, why would they cancel the permit?

My work permit book had to be handed back to HP in Sept last year when i left, and they withdrew it. However, my Visa was still valid until this month, and now i'm in the process of getting a new work permit.

As long as your Visa is valid, i don't believe they can cancel it. You don't actually use your work permit to enter the country, you use your Visa.

no way to be sure i am afraid unless you specifically ask your old HR department as to exactly what they have done. It is a big hassle cancelling a residence permit without your passport, so they may not really have done it. However, seeing as they specifically said they will cancel the RP they may well do so. One of the reasons is that each organisation has a limit on the number of work permits and residence permits that can be issued linked to them. They may be in need of recruiting another foreigner so could be cancelling yours to make way for him/her. Thats speculation though.

No ugly termination at all - just a inter company transfer from one Hotel to another Hotel outside China.

I asked my HR what they will do as I was curious since my replacement is a foreigner as well. They said they will cancel online once I will be gone. The HR staff could not really answer my question as to whether I can still enter China with the Permit in my Passport since it does not have the big ol' canceled stamp on it.

I will keep you updated once I hear back from HR and the PRC Visa Office.

If it's canceling online, then it's just the work permit. Companies register so that they're allowed to do that online. The visa isn't canceled online.

Typical B/S, just ignore. No way they can cancel your residence permit without having your passport in their possession.

The resident visa can not be cancelled online. You can use it till the expiry date on it.

Sounds like they mean your work visa paperwork, though be advised if they really wanted to, they CAN cancel your RP if they want to go thru the hassles... but its not an online process.

That's what everyone says but it just seems ridiculous. Does anyone know of anyone else that has been stopped at Immigration because their credentials had been canceled in the system, even though their residence permit never received a red canceled stamp? Probably not. But I'd like to hear if anyone has. It just boggles my mind that a country as big and "glorious" as 2009 China would base the validity of immigration status on whether or not a red stamp has been placed in your passport.

They can not cancel your resience permit without your passport. So it should be no problem for you to enter China with the residence permit before the expiry date.


Yes, they can have your residence permit canceled even though you do not physically surrender your passport.

That said, they will rarely do it because the local PSB needs to involve the Ministry of Public Security to make sure the cancellation is reflected in the system. Unless you have really pissed them off, the local PSB will not usually invest the time or effort (Ever see a cop here that wasn't lazy?). Even if they do, the cancellation applies 1 - 4 weeks after the PSB has personally notified you.

Yes, u can use the residence permit to come to China until 2010 for short stay if there is any chops on ur residence permit page,but it is illegal to work here anymore .if u wanna work here or you find a new job here ,you should apply for a new work permit .

I just heard back from our Regional HR as well as our Office in Shanghai. You can indeed cancel a Resident Permit without the Passport. And so they did. I received an email today from HR with an attached official Ministry Document stating that my work & resident permit have been canceled.

I should now go the nearest PRC Embassy or Consulate in the Country where I live in so I can get a "official Chop" to cancel it in the Passport as I can not re apply for a L Visa in the future without the Cancellation Chop.

Well Mister "it-just-seems-ridiculous". I got a friend who resigned from work few months ago and got his work permit revoked.He still has his residence permit without any canceling stamp and he's still traveling in and out of China without having been asked any questions as ling as his residence permit is still valid.

Got his work permit revoked how? They told him so? My people told me that too, and months later, after I left and came back without raising any eyebrows at the airport, I called them up just to see if they really had. Sure enough, even though they had told me before that it was canceled, they admitted they never got around to it. But if I hadn't asked them...

I guess you are right - I won't post any Documents since I don't like posting things with passport Number, name and other stuff in it. Anyhow, as I don't read Chinese I somehow relay on People who do to tell me what said Document said.

As I live in a Country now with not that many Chinese speaker around I had nobody around to translate on the Fly. And I am not that Computer savy either so I am not aware of how to translate a scanned, protected PDF file from Chinese into English online. I emailed the thing to a friend of mine who could translate it since it seemed a bit fishy to me what HR claimed after what you guys posted.

So yeah, call me naive as I might have posted a bit premature. All the document said is that Work Permit ### is cancelled effective August 31 2009.
