| Post subject: breaking an employment contract - ramifications? |
Hi,
I may me relocating to Shanghai with my girlfriend. The jobs she is eligible for typically require an employment contract that would be longer than mine. i.e., we may need to return to the US before her contract is fulfilled.
Anyone know what happens if you break an employment contract and simply leave early? Her contract may involve housing of some sort. if it's only a loss of several hundred dollars US or the cost for a flight home it is not really a big deal financially.

Depends on the contract terms. Some require the repayment of all visa and work permit fees, others may include more penalties and still others may be more flexible. In most cases i have seen,. if proper notice is given most companies are fairly tolerant. |

i may be wrong, but since so many chinese company do not care about the people when they brake a contract why the op should be?
eventually will they come back to china or not?
what would it mean for them? except may be loose the last month salary they will not collect if they do not come back to china?
do you think the company is going to sue them inn america?
anyway it is never a good sign to cancel a contract, but i had a few chinese people do it on me so i think that i probably would do it to them ............ may be, but in another hand i want to stay in china since i married chinese and feel good here.
if you are talking about an american company may be different and may be you need to look into it.

Soop, as you said it is a CONTRACT so read the contract conditions carefully before you go into it. It is always better to discuss the differences in contract conditions before you signed. |
