| Post subject: From HK to SH - can we bring her? |
Hi folks,
There's a possibility that my family will be re-locating from HK to Shanghai next year due to my husband's work/ business.
We have a wonderful Filipino helper here who we would like to bring along with us if we move. We consider her part of our family and having her around would be invaluable, specially as she is fantastic with our kids.
Question: Could we legally bring her with us and continue her employment?
Thanks in advance for any info and advice you can share! I've tried to search for related topics on this site and have not found a clear answer, so really appreciate any input.

The short answer is no.
The longer one is "possibly", but with so much messing around/illegality that it makes no feckin' sense at all.
Also, you might want to try the Google forum search at left to research what is involved (this topic has been covered before many times).
Same applies to any number of often-asked questions you're likely to have. |

in answer to your question:
A: Without a work permit you cannot bring her legally. It is extremely unlikely a Fillipino would get a work permit as an Ayi. China is not short of Ayis. |

As Shangstar said - China has so many ayis working here, esp in Shanghai, then there is no chance of her being granted a work permit as an ayi.
The emphasis being "cannot bring her legally" - with an official work permit.
There is another option (f-visa), which isn't really legal, but an option many foreigners use to remain in China indefinitely in the absence of having a formal work permit. While this "grey area" has been tightened since last year - it is still commonly used.
I'm sure many people are going to jump on my case here about giving this as an option, criticising me for suggesting you break the law. However, the reality is, many people do this still option and go on for years renewing their F visa every 6 or 12mths in HK. Of course, its not officially legal.
Just like 5rmb dvds are not legal, and having satellite dishes stuck on your apt wall are not legal, and buying fake iphones, designer bags, shoes, - but we all have them. This is China.
Of course, if you are 100% attached to your filipino ayi, then you may consider this option. However, you should also understand that there is always a risk involved. My personal opinion is that she should stay in HK and find another job there, if she can. Of course, finding a good ayi in Shanghai is possible, but not easy. |

Your Chinese neighbours will be suspicious of the Fillipino. They may dob you in. For peace of mind if anything, leave her in HK, and hire a local Ayi. Otherwise you will be held responsible for illegal employment, and morally responsible for your maid being fined and deported back to the Phillipinnes. A few days ago, as reported in the local press, an apartment with some Fillipinos was raided by the Shanghai police on the basis that it was overcrowded (didn't meet the minimum square meterage per person for the house). These small technicalities are very rarely if ever enforced. But the Police will use things like this to crack down on this kind of illegal employment. I doubt if the same would happen if a load of English teachers bunked up together in the same room. |

With the possibility your Work Permit and Residence Permits will be nixed also.
