I signed a one year lease. In the lease it says that if I am leaving I have to give the landlord one month notice. Does this mean anytime during the lease I can leave as long as I give a one month notice without penalty?

Why did you not ask the landlord before you signed the lease?
Contract is hard to interpret till we see the actual lease you signed on. |

no most if not all residential leases in shanghai require you to give one months notice if you leave at the end of the lease. If you leave in the middle of the contract you will most likely loose your bond and some make you pay until they find someone to rent it.
I think you need a chinese friend to read the contract for you and explain if there are any penalties. |

There should be a section in the lease that refers to breaking the lease and penalties which, as said above, mean that if you break the lease during the term, you loose your security deposit. In fact if you aren't going to renew your lease then theoretically you don't need to give any notice at all. Just let it run its course. But it is best to let the landlord know that you will be leaving so that he you can get bills sorted and he can prepare the deposit for you and tie up any loose ends. It also allows him to put it back on the market.
Sometimes, if you need to break your lease during the term and there's no "break lease clause" or "diplomatic clause", a landlord will allow you to leave without penalty as long as you can find another suitable tenant and they don't have to pay a commission to an agent. It really depends on the landlord and the situation.

usually, it is normal for one to advise the landlord at least a month before you plan to leave - this is so the landlord can look for other possible tenants to take over your place. but as most of the posters have suggested, there should be that portion of pre-terminating the lease on the contract. better to ask your landlord about it and have it documented to avoid future misunderstandings. am not sure about the deposit through, that they usually give back... cheers! |
