Post subject: Visas & Setting Up a Company here

I've looked all over this site and on your blog Yu888 (which by the way is fantastic - thanks) but I still have a question:

My husband is in the (long) process of setting up a branch of his company here. Until it is set up, is there anyway he/we can get either z visas or residency or do we have to wait until it's all up and running and then apply? And also, if the latter is the case, who 'invites' him to work here seeing as he's set the company up himself?

Any answers would be GREATLY appreciated!

You can apply for the work and residence permit after having your company's business registration, you dont need to wait till all the registration formalities are done. If you have your own company, you don't need the invitiation letter, even if you need, it will be provided by the foreign commercial bureau according to your application which is under your companies name. The Chinese law doesn't allow the setup of the "branch" of a foreign company, it's either a representative office (no legal existence and very limited capabilities) or a new wholly foreign owned company (can have a foreign company as its investor). As Mira said once you get your business license you are good to go to apply for the residence permit.
