no, colluding is not really needed. It just helps to have someone there who also understand proper odds. Its Macau, so the game can get quite erratic on the weekends. I prefer a stable game. |

A SHANGHAI court late yesterday was pondering whether two foreigners would spend up to three years in prison for running a gambling house that allowed them to pursue their passion: Texas hold 'em poker.
The men admitted they knew gambling was illegal. But they said they were running more of a club than a profit-driven casino and didn't think authorities would consider their actions to be a serious crime.
Judges at the Shanghai No. 2 Intermediate People's Court, which heard the case yesterday, said it was rare for foreigners to be caught running a gambling house here. The court did not say when it would announce a verdict.
Prosecutors charged that Patrick Liang, 27, a Chinese Brazilian, and Al Gokcimen, a 44-year-old Australian, conspired to open a gambling house in February. They rented an apartment on Xinzha Road, laying out more than 60,000 yuan (US$8,778) to equip and open the place and paying 9,600 yuan in monthly rent.
The duo then invited other gamblers to play the highly popular Texas hold 'em, in which each player receives two cards face down and shares three cards that are dealt face up.
At first, players were charged 40 yuan an hour to join the games at the apartment, which earned 8,000 yuan in the first month. In mid-March, Liang and Gokcimen decided to bring in two other partners, Hu Weimin and Qi Fei, and the four agreed to collect 3 percent of the table stakes as profit, prosecutors said. Hu and Qi will be dealt with at a separate trial.
Police raided the poker parlor on March 19, catching 17 gamblers and confiscating 29,800 yuan in bets.
The defendants told the court they decided to open the place because they were poker fans themselves.
"I used to play poker at gambling houses run by friends and had to pay more than 10,000 yuan each month just to play there," Liang said at the hearing. "To save money, I decided to open a gambling house myself and discussed the idea with Al."
Liang said the men called their enterprise a club and claimed that it was legal in many foreign countries. Liang said he knew it was illegal in China but didn't think he would face criminal charges.
"We were too naive," Liang said.
He stressed that neither he nor Gokcimen intended to earn a living on the gambling house profits. He said he made money by teaching violin and translation and the Australian had a job as a corporate consultant.
"We didn't actually make any money," Gokcimen said. "I was foolish to have made the decision." |

Yep, ABSOLUTELY stupid that they did this. All it took was some local guy to lose a bit one night and then dob the place in.
In some way, these things are not illegal, BUT it is a fine line when you are running an organised venue like this out of an apartment rented soley for that purpose. |

I just wanted to clarify that the reporter who wrote this article misunderstood what went on court. It was never said we made 8k. We net more than 8k in volume, but lost money overall with the investments. The 8k mentioned in court was the management fee, which was agreed with Al at the beginning of the venture, but the deal was left aside later, when Willian and KT (Hu Weimin and Qi Fei) joined us.
What very little people know is that by the time Willian and KT joined us, I was no longer the mastermind of the operation. Willian was. He is the one who changed the games from table fee to a rake game. When the police caught us, AL and I got charged bc we initiated. Willian pledged to be mental retarted or something, and suffer depression and never went to jail.
Al and I ended up getting 6 months and we got released on sep.18th after a second hearing.
After going out, i have heard that Willian has again got arrested on another game, along with some of the local players, but once again got released bc he pledge the same story.
I am not saying we don't have any guilt, but we have paid our price....
After our case, i have heard of many texas holdem clubs shut down and a few other clubs got busted as well... |

Yes, we got this last friday. They let us stay in China bc we both have families here plus we showed good attitude and cooperated with the police during the investigation.
It is not that we got out early....gambling max penalty is 3 years....we ended up getting 6 months, which was the minimum penalty. We already served it since we were locked since march. We waited 5 months and half for the trial, and that period counts.
I have heard that two other clubs got busted after mine did, and that some of the traditional clubs also shut down....
Also i read on some threads that playing poker is fine, but running a club is illegal...actually, according to chinese law, even playing is illegal and u will be arrested for it. If you get caught playing, usually u will be given administrative detention of 10-15 days. If they discover during this time you are a professional, ur penalty is also up to 3 years, although while in jail, all the gambling cases that i met were all gambling operation owners...and never a professional gambler.... |

Not if it's done within the rules. Problem is, Police have the power to detain ANYONE for 30 days regardless, so if you get caught and they don't like you, regardless of whether correct or not, you will be detained 30 days.
These games are fine under following circumstances.
1 - Not in a club or venue
2 - No rake taken
3 - less than 12 people per game
4 - Under 50,000rmb total stakes over the entire game. |

According to Criminal Law of the People's republic of China:
Article 303 "Whoever, for the purpose of making profit, gathers people to engage in gambling or makes gambling his/her profession shall be sentenced to fix-term imprisoment of not more than three years, criminal detention or public surveillance and shall also be fined.
Whoever, runs a gambling house, shall be sentenced to fixed term imprisoment of not more than three years, criminal detention or public surveillance and shal also be fined. If the circunstances are serious, he/she shall be sentenced to fixed-term imprisoment of not less than three years but not more than ten years and shall also be fined"
This was part of my indictment.
When we got caught, we had 30k at the table, so it was under 50k. we had 13 ppl playing, but only 9 were customers.
The cops told me that as long as you try to make $ out of the game, ur brking the law. I heard a case while in jail, of 1400rmb, and the guy got 4 months.
What u said abt playing at home being legal i think it is a somewhat true but still a misconception. In general if you gamble at home u will never get caught....just like if u smoke pot at home, u probably will not get caught...but it is still breaking chinese law...It takes someone to call the police for them to come...
I am not sure if i was very clear to my thoughts, but i am just trying to give my insights abt the situation, and i am sure a lot of people are wondering what is legal and what is not.
Gambling in China is ILLEGAL. Doesnt matter if you rake or not....of course, if you r running the game or if you r just playing will be given different punishments. If you are playing small, the cops may not imprison you but they have the rights to confiscate your money whereas if you are raking it, you will receive a criminal charge. I hope i was clear with my thoughts.
If anyone has questions abt Chinese law, you can shoot it here...and i will give my opinion. During the litigation process i met all sorts of cases, from murder, drugs to gambling and fraud cases and so on. |

Anyway, this Aussie guy **** up and deserved what happened. WHY the hell would you risk such a thing for zero reward? Probably close to natural selection i reckon.

English isn't my first language, so maybe you just misunderstood what i wanted to say, or maybe i wasn't clear enough with my thoughts.
I am not looking for sympathy whatsoever. I am speaking for myself, and not AL.
I do agree with you though...we got lucky and should just move on...
I do want to thank all of those friends who cared abt AL and I during this process...it is heart-warming to know that so many worried and cared abt us during this incident...  |

Glad you are out and back with your families
It has been good playing with you and al..during those spot days.
It was a relaxing monday night..win or loose 150 RMB for the night drink 20rmb beers...it all gone now.
Actually i felt china was still a gracious host. If you were caught in a similar situation in another asian country, it would be an entirely different story. |
