| Post subject: Overstaying L-Visa with 5 days, consequences ? |
Dear all,
I unfortunately have to overstay 3 months my L-visa with 5 days as before i go to HK to renew it, I have to stay in Shenzhen some days.
What are the consequences of this when passing the Shenzhen/HK border ? and could it affect my L Visa renewal in HK ?

It shouldn't affect your renewal of "L" visa in Hong Kong as it is relatively minor.
As Yu888 said, you'll get a bit of a lecture but just take it on the chin, look regretful and apologise profusely.

^ It most certainly can and often does affect whether or not you can get a new visa in Hong Kong or anyplace elese in the world for that matter.
If they put the kiss-of-death notice that "Bearer Must Leave China By ____" in your passport you will not get another visa in Hong Kong generally. |

Overstaying is not relative minor. Surely in the months stay already the OP could have made a visa trip so as not to overstay.
Some countiries now have automatic 12 month bans on overstayers being able to receive new visas. After all if you have oversayed once there is a likelyhood that the person may overstay again.
Most countries prefer to keep illegal immigrants out.
The OP is in Shenzen, so how can a few hours out to make a trip to HK be so difficult?
The OP might want to reflect on what it would be like if refused for a further visa for China because of a choice to overstay. |

Hi, I met a couple with a 1 year old baby. They are Asian family. I wonder if someone can tell me or at least any idea, what is the maximum penalty for the overstayed visa. I think they're been here for 3 years. They said they have the money to pay for though they are not certain how much but they are quite ready to face the consequence/s but I pity them because they said if they pay it rigtht now they will be ban for 5 years (since Olympic was just finished maybe laws will now change again)and there will be a possible detensions.
The baby was born in China and have a birth certificate but don't have currently a passport of his nationality. The parents are both confused and they are seeking an ideas/ or some sort of good advise. They where trapped by agents who promised to keep there visa's for good but left for nothing.
One more thing they wanted to go for the boundary like Guangxi/shenzhen and pay over the counter for the visas overstayed penalty and out for China if possible but they are UNCERTAIN HOW THEY DO IT. They just good christian happened to be trapped. Is it possible for them to go to lawyer or what........?the next thing that they should do?
I just known them in the church circle, please let's help by giving them real info's thanks! |

Last year, I overstayed 20 days. Apart from a lecture by the local police on why I should not do this and the risks associated with it, I just paid a fine of around 500. After that, I was able to renew my VISA. However, my case may not be entirely representative because I am married to a Chinese (Shanghainese) citizen and that did help a lot in negotiating with the police. My suggestion is that you go to the local police stationas soon as possible, admit that you forgot about your visa expiry date, and apologize, apologize, and again apologize. Good luck! |

They can always apply to their Embassy for their childs nationality registration and get a passport. Too bad the child is also an illegal as well.
But overstaying 3 years is not a minor offense and they may get put in a detention center until all the legal processes are completed. A lifetime ban on returning to China is also possible once they are deported.
They may find that just trying to leave at a border crossing is not so simple with such a long overstay. |
