Post subject: Employment Permit/Residence Permit/Spouse Visa
For those waiguoren who need to take care of their employment permits and/or obtain a visa for their spouse, here is what you need to know. I just obtained mine and want to make clear what is needed.

Changing Companies

1) Ask your former company to issue a chopped letter saying the date you left the company and the reason for your departure. If you left for a new company, state the name of the company in the letter.

2) Bring this letter and your employment permit to the Labor Office located at 865 Zhongshan NanLu. Their website is: http://www.12333.gov.cn. Phone number is 63650095. They will issue you a chopped form stating that you left your former company.

3) If your company is still in Shanghai, you can take care of the following at the same office listed above. If not, simply do a Google search using the name of your city and LaoDong BaoZhang Ju 劳动保障局。I changed my job to Wuxi. Their facility is at the XinChengDaSha 新城大厦. You need the following items to obtain a new employment permit:
- The chopped form issued by the Labor Office mentioned above
- A copy of your new company's business license 营业执照
- A chopped letter from your new company stating their intention to hire you. Make sure this letter is written on company stationary and mentions your country of origin and passport number.
- A copy of your resume in Chinese and chopped by your new company.
- A copy of your new company's organizational structure number 组织机构代码
- A copy of your new company's Foreign Invested Company Approval Certificate 外商投资企业批准证
- A chopped copy of your contract with your new company
- A copy of your passport and previous residence permit/visa. Bring your passport too.
- 2-3 copies of the Employment Registration for Foreigners in China form 外国人就业登记表all chopped by your new company (in Shanghai you need 2 forms, but in Wuxi you need 3 forms). Please note that these forms are not the same in each city. Call or go to the Labor Office to obtain the forms and have then chopped.
- Bring 3-4 passport photos, depending on the city you are in.
- You need a copy of your diploma from your highest degree. You also need it translated into Chinese (by anyone will do). Both copies need to be chopped by your new company.
- A copy of your Registration Form of Temporary Residence 临时住宿登记表. You get this from the PSB after you register with them when you move into your new residence.

You will obtain your new employment permit soon! After you finish with the procedures, the Labor Office will chop your Employment Registration for Foreigners in China form. Be sure to bring this form to the visa office as mentioned below. If this is your first time applying for an employment permit in China, you also need to have a health examination. Please contact the labor office for more details.


Changing Visa After You Change Companies

Go to the visa office in Shanghai. It is located at 1500 MinSheng Road in Pudong. Take Line 2 subway to the Science and Technology Center. Take the number 3 exit and follow the signs for several blocks. Go to the third floor. To change your visa you will need the following:

- Your new employment permit. You will also need a copy of the first 4 pages.
- The Registration Form of Temporary Residence 临时住宿登记表
- The Employment Registration for Foreigners in China form 外国人就业登记表chopped by the Labor Office
- A copy of your new company's business license 营业执照
- A chopped letter from your new company stating their intention to hire you.
- A passport photo.
- A copy of your passport and previous residence permit/visa. Bring your passport too.
- When you get to the visa office, fill out one of the forms to change your visa. They are available in the back. If you need to change your address, do it at the same time.

The visa office shouldn’t need to take your passport unless your previous residence permit/visa is about to expire. If you forget one of these items, you can send it back to the visa office (be sure to have it delivered to the agent who waited upon you) via a messenger service. Call 6468-4093 for a delivery company. It will cost about 28RMB for a delivery in town.


Obtaining a Residence Permit for Your Spouse

Go to the Shanghai visa office as mentioned above. The Residence Permit can only be applied for after you have obtained an employment permit and changed your visa. Your spouse will need the following:

- The Registration Form of Temporary Residence 临时住宿登记表
- A copy of your new company's business license 营业执照
- A passport photo.
- A filled out copy of the forms available at the visa office.
- A chopped letter from your new company stating their intention to hire you and that your spouse is indeed married to you. Names and passport numbers should be mentioned.
- A copy of your marriage certificate. Bring along the real copy too.
- The spouse’s passport.

You will have to hand over the spouse’s passport. It will be ready in 5 working days and will cost 400RMB. The new residence permit, which will qualify the spouse to work in China, will be valid for as long as your residence permit is. Your residence permit validity is determined by your contract date or the expiration of your passport, whichever is earlier.
