Do you think a case against an employer for workplace bullying would be given the time of day here or is that just a little expat pipedream? |

Although, if you went through the company (talk to his boss), you might get something done, especially if it's a foreign company or you're a valued employee. Through the government, as was said, expat pipedream. |

Birdlady, I would write a mail to our legal beagle Mr. Erex Chen at
erexcxl@yahoo.com.cn. I would explain the whole situation in detail so he can get a good overall perspective and advise accordingly.
I say GO FOR IT but expect a roller coaster ride!

Also expect to pay a lot of money and likely make things a lot worse for yourself. This is China, not America.
Just because the lawyer might think it is a good idea (because he gets paid) doesn't mean it actually is. |

When you say workplace bully - (male boss), is it physical intimidation, verbal abuse (yelling/screaming - pointing his finger at you), or making you do things that you don't want to.??
This will have an impact on what your options are.
Unfortunately, this is China, and many HR principles/protection that exist in most developed countries often don't exist here - and this may be one of them.
Even if in the letter of the law in CHina - you are right, then there is the enforcing of the law - not too common at all.
If its a foreign-owned company - there is a chance, as you can go above and outside the China office. If he is the boss in a Chinese company, if you push it - you might just find that your contract isn't renewed next time, or you're handed 1mth notice at some stage. So - is it worth pushing it? You need to consider it.

Is the job really worth the hassle?
Might be easier just to update the old resume, ask the boss for a reference, and start looking for a new job while you still have a reference.
BTW, is the boss foreign or local? Out of curiosity. |

It doesn't matter HOW RIGHT YOU ARE, think about how much is going to cost you (lawyer fees), and what it will be the outcome. Here, you are a 'laowai' and you know they don't like us, do you honestly think that somebody is going to bother to give 'fairness' to the laowai?, NOT REALLY.
If the bully is your boss, the only smart thing to do is to hit the road as quickly as you can, if you fight it is UNLIKELY that you will win unless you get support of your colleagues (if they are Chinese, you know they are cowards in general so you will be left alone on this one).
Like one of my lawyer friends told me once: 'It doesn't matter if you are right or not, what it matters is that you can prove it'

Didn't you just arrive here? How did you learn so much about Chinese people so quickly? Is it personal experiences or have you become expert just from reading Marakanis's posts? |

Ok - I don't think Chinese dislike me or all other laowai. I am sure some do. So I disagree with the statement that 'they don't like us'. As far as being cowards goes - I don't feel strongly one way or the other. I am certainly not prepared to label them all as cowards. |
