| Post subject: common-law relationship? |
I was hired by a company in Shanghai and they are sending me the invitation letter and employment license. When I asked them about my spouse and child's visas, they said that they can enter China on a tourist visa. After my Z visa has been changed to a one year multiple entry visa, then my spouse and my child can apply for theirs. I guess she meant dependency visas here.
Now the "problem" is that my spouse and I are not married. We are in a common-law relationship, which is legally recognized as the same as marriage in Canada. Chinese consulate in Canada recommend us to prepare a letter from our lawyer stating that we are in the common-law relationship if we want to apply his dependency visa here in Canada.
My questions is that if we have to apply his dependency visa in China as my employer suggested, will the local Chinese authority treat our common-law relationship as marriage too and grand him a depency visa??? We have the letter from our lawyer already.

pfft. good luck. our US marriage certificate was crap here. we have to go back to the US and have it go through a process. we tried the common-law relationship (we had a baby to prove it), but it didn't fly, even though my husband's a Chinese citizen. however, we didn't have a lawyer prepare a letter, so maybe you might be ok? |

additionally...
as a suggestion... no matter what you do, if you are outside the country, make sure that any documents you have or get e.g. lawyers letter etc. that they be attested by a Chinese consulate and maybe even translated and attested. it's worth keeping in mind where English is not the first language, that often documents etc should be translated into the first language of the country for authorities to deal with. same as when in an English speaking country, the governments will usually require translation of documents into English.
and common law "marriage" is not marriage, and in many countries round the world de-facto relationships are not recognised for good reason. |
