| Post subject: Double time on weekends |
The new labor law says that employers shall pay employees twice thier normal rate if they work on weekends.
What are all the retail stores, banks, restaurants, service businesses etc doing?
I cant imagine business can follow this new law verbatim. |

Business in such industries like retail stores, restaurants, banks and other service business and so on generally follow shift system, which roughly ranges from two shifts to three shifts. The current five days work system has been in practice for more than a decade and has become a work concept which bears a connotation of five work days plus at most two legitimate leaves in a week. As in, there are no fixed leave days but only the fixed number of leave days in most of the service business you mentioned above. Five days work system, conbined with two or three shift system, leaves much room for the human resource departments to work out the schedule for every single employer to chase the maximum of surplus value acquisition. |

Actually thats what we do at the factory, we give some people Monday Tuesday off, others Wednesday Thursday etc but the new lablor law does not define the rules for service industries vs. industrial. The law simply says companies shall double time on the weekend.
If in fact the only solution is the above, how is it the service industry employees are not demanding double wages as my employees are? |

I'm not sure what the exact definition of weekend is nor whom that applause is pratically aiming at. I'm not in law. But pretty sure that in such circumstance you'd better not pay double wages as the applause subtly refers. There is no such concept of weekend practically in service industry nor five-work-day-and-two-legitimate-leave services.
It is not the case that the service industry employees are not demanding double wages but it is definately the case that their human resource department or, to be direct, their employers are playing tricks on that issue, they are actually availing the loopholes of our incomplete law system with the absence of supervision. As for what kind of tricks they are practicing I'm not sure because they have guts to embrace any shamelesspretexts, lies and cheats. As I know, most of the Chinese firms are way too stinky, they don't even pay for overtime work, never, let alone double pay on weekends. As in it is the matter od company rather than the law. It is all due to the LACK OF SUPERVISION.
Since there are no other related applauses in reference, I think the subtle indication is that you don't need to bother to give account to those emplyees in sevice industry, even though some of whom were given fixed leaves on Saturdays and Sundays, nor those who are undertaking five-work-day-and-two-legitimate-leave work system as in your factory. |
