Notarized terminate leasing contract, how to deal?

Postby estherISmyNAME » Wed Nov 16, 2011 9:53 pm

Hai all,

We got this Notarized Terminate Leasing Contract from our landlady by sudden, our contract origanally terminate at May 2013.

Anyone know how to handle this? Beside trying to talk with her..as we already tried Asking her to discuss this matter in the grown up way, not success as she think she's own the world and can change all the clause in our contract according to her benefit.

Is there any china law can help us with this matter? As we've been told, there is no way we can win this case..owner always win in china. Is there any justice happen in this country?
We are ok to move out from this property ( as we sick and tired with how she treat us all this time..) but we want our deposit back..which she said, by China law she have fully legal right to take our deposit (it's stated other way round at our contract). Any trick to get our money back?

Both party is foreigner, this landlady nationality Korean and we're German.

Any advise to help us out from this problem, greatly appreciate ...

Many thanks,

Yeah, if you are worried about getting back your deposit, either write
it off as lost, or don't pay the last several months rent to deplete the deposit

Was your current contract notarized by third party such as a real estate agency? Standard contract will include a non-performing clause specifying the amount penalty. This clause covers early termination by either the tenent or the landlord. In my case, it is equivalent to one month's of deposit. My landlord is obligated to pay me this amount if he wants to terminate the contract.
You should get your deposit back plus the additonal amount per your current contract.
I am not quite following the notarized terminate leasing contract. It is a contract between you and your landlord, was the terminate leasing contract created without your knowledge or presence?

As above. I do not understand the notarization. Sounds very fake, to scare you.
The standard agreement includes a penalty that you can claim, PLUS your deposit.
If you think you will lose deposit, stay your ground till it is used up, then leave, and set fire to the place.

Ha Ha. And the signature proves it.

OP: You have a right Biatch there. Stick to your contract, She cannot evict you, or steal your deposit, so long as you have paid your bills etc. Failing that, contact Jeff Li on this forum.
