Transfering Chinese property after death

Postby Stpepper » Sat Oct 02, 2010 9:33 am

TLDR: Can anyone recommend me a lawyer that deals with wills, property transfers and foreigners in Guangdong? Yes I *do* realize this is a Shanghai forum but there doesn’t seem to be a very active Guangzhou forum in the internet.

I have a question on wills and Chinese property. Recently a property of mine passed away. He owned some real estate in Guangdong province. I believe that passing the real estate to his wife shouldn’t be a problem, but apparently, because both my relative and his wife are foreigners, she has to get:

1) One official certificate stating who my relative was married to, how many kids he had, how many times he was married and so on.
2) Same thing for the wife.
3) Some other things. All of this have to go through the public registry(Notariain Spanish? I’m not sure if that is the English name)

Right now the wife is stuck with the property because the property was under my relative’s name alone and not hers. So she can’t sell or start big improvements on the property. The first priority would be have the power to legally to sell and fix/improve property while we go though the motions

Thanks
