URGENT Visa/Employer Problem

Postby xvxmatthewxvx » Sat Jul 15, 2006 10:03 am

I posted a few months ago about visas and China. Let me ask you a question now please.

Since I came to China, I realized I am not suitable for teaching. So my employer tried to scare me about quitting and paying 1000US dollars. I did not have that kind of money at that time. So they made a compromise that I do tutoring, I was scared at the moment so I agreed. The contract says I must work 13 hours a month free. The problem is I often work exactly 13 hours free or a couple of hours more a month and my salary ends up to be about 200yuan a month. This is not acceptable for me to live! I am not wealthy. The reason for the free work is to pay for the "visa".

Later I get a thing like this in my passport (except my says work for the reason) Image

My first question is what exactly is this? Z Visa? F? I have no idea. This is all I have from my boss. Its in my passport.

I have a lawyer friend. He said I should change apartments (cause the apartment is in my bosses name) I did, paid all damages to old apartment and got a paper that said "the apartment was left in good working order" I also lied and said my girlfriend's parents are finding a nice apartment so I am living there for now. I said this so my boss doesn't know my new apartment's location.

I want to quit, I am tired of working there for free. The lawyer suggests the contract is illegal and breaking a contract is a minor thing not worthy of a visa cancellation. I plan to tutor myself and earn my own money. I already have classes prepared.

I live in Changchun in Jilin province.

So my question is, I have NO plans to ever work for a Chinese company. Can my boss cancel whatever this thing is? and what exactly does this thing do?

He claims he has high up friends, this I am only 50% sure about.

And also can I renew this easily? Is this enough to work in China or did my boss cheat me?

All these questions are very important cause I plan to quit today PLEASE someone help me and answer me today I would be eternally grateful! This has been a nightmare.

I just want to stay in China! if I can't work for a company I don't care!

It looks different from my visa - mine indicated that it's a Z visa. But I note 2 weird things as well.

1. The visa is for someone in Zhejiang Province, Hangzhou city.
2. It's for a student, not an employment visa. Perhaps that's why there's no Z printed on it under type of visa.

If your boss claims he has friends high up, you might be in bigger trouble than you thought if that's real. This is China, where laws, enforcement and relationships are a whole lot different from the developed world.

Go to your embassy or consulate to seek help. That's the best suggestion I can give now.

Hehe nono! This is a sample one! Mine says Changchun Jilin, and WORK for reason! hehe But looks 100% the same.

In the bottom has some numbers. R<CHN(my last name)<<(my first name)<<<<<<<<<< But its the same as this. Looks 100% the same and no indication what kind of visa it is, except for a R in the bottom right corner.

Nothing your boss can do if you just walk and hop on the next train to the big city like Shanghai for example. You can get a visa company to change your visa so that it is in your name or the agency and then they can't touch you. Too many bosses scaring lao wai. Many times these are empty threats. PM for more details on how to solve your problem.

Apart from your residence permit, was there a contract that you signed? What is in that contract as that will have bigger implications on what you can and cannot do. As a guide, all employment requires a signing of contract of sort that will be submitted to the labour authorities. This is so that when disputes arises, the labour department will mitigate. As there are no unions here, the labour department is the law. They are quite powerful and if they say you cannot fire someone, you are stuck with that person. On the flip side, you did mentioned that he threatened you with someone higher up, tread carefully. First find out what you have signed and decide from there.
