Hey everyone,

Thanks for reading. I got a call yesterday from the police. The officer on the phone told me that my AirBnb guests were caught without their temporary registration permit.

I am out of town at the moment but the police requested that I go in a visit them as soon as I am back. Needless to say, I am quite worried that the police would want to see me in person especially over an issue like this.

Is it a good idea to visit the police station? I don't want to create an unnecessary trouble for myself and the landlord. And lets suppose I don't visit them like I was asked to, what would happen?

Any help or advice would be much appreciated.

Is it actually legal for a foreigner to sublet a rented apartment to air B&B guests? I think you'll find yourself falling foul of immigration and registration laws.

If OP, in his contract with the landlord, indicated the right of subletting to 3rd parties, than he is fine.

Sub letting is one of the no no's written as standard into every renting contract I have ever seen. Easy way for the landlord to keep your deposit and kick you out.

Also ask yourself why your "guest" was picked up for by the police in the first place. A random stop and search or was the individual stopped for something more serious.
I'm not saying I should kill ALL the stupid people, I'm just removing the warning labels and let the problem sort itself out!

I have always found the police in the registration section very pleasant and helpful. I don't understand why anyone would want to flaunt the laws by not registering. It is actually no big deal.
However, and as other posters have asked, if they were stopped and asked for their Temporary Registration it does beg the question Why?
I cannot speak for others but in all the years I have been either living in or travelling within China I have never been asked, other than at banks and hotels, to even produce my passport. I know they do stop and search on locals, seen it many times in trains stations etc, but Have never seen of a laowai.
I have a sneaky suspicion that perhaps they attracted the attention of the police in some way and that could be a problem for the OP in turn.
Hmmmmm..... Am I Cynical? In Shanghai there are 2 little words meaning No. These are"Yes" and "Maybe".

I have had people come to my apartment and ask "How many foreigners are living at this address?" and ask to see our passports twice. Once in 2010 and again about 3 or 4 years later. It was clear they were checking the names and passport numbers against a list, presumably one of info provided by the registration office. Was not just me, they were going through the whole neighborhood. So, it happens. I can't say what prompted it in the OP's case; in mine it seemed like it was just some routine box-ticking exercise.

Maybe I have just been lucky.
They should do that in the UK. They would get a bloody shock

Yes, cops have dropped in at my apartment thrice in the last 5 years to say hello and asked to see my passport. Just a routine check I believe. Officer Wang, she's well mannered, good looking, and speaks decent English!

On the street, malls, metro stations -- nope, never been stopped so far.
